A JOINT RESOLUTION | Proposing to enact Section 1h of Article II of the
Constitution of the State of Ohio to authorize the
General Assembly to invalidate rules proposed or
adopted under a statute, and to create and empower
one or more joint committees of the Senate and
House of Representatives to review rules that have
been proposed or adopted under a statute and to
make recommendations to the General Assembly
regarding those rules.

Be it resolved by the General Assembly of the State of Ohio,
three-fifths of the members elected to each house concurring
herein, that there shall be submitted to the electors of the
state, in the manner prescribed by law at the general election to
be held on November 4, 2014, a proposal to enact Section 1h of
Article II of the Constitution of the State of Ohio to read as
follows: |
1h. The General Assembly, by concurrent resolution,
may invalidate rules that have been proposed or adopted under a
statute. |
The General Assembly may enact, and subsequently may amend or
repeal, statutes creating and empowering one or more joint
committees of the senate and house of representatives, in
conformity with standards prescribed in the statute, to review
rules that have been proposed or adopted under a statute and to
make recommendations to the General Assembly with regard to those
rules. Such a joint committee shall be comprised of an equal
number of members from the senate and house of representatives,
and may be assigned jurisdiction with regard to general or
particular subjects. |
A statute enacted by the General Assembly that is currently
in effect, but the validity of which is or may be questionable
under the law as it existed before the adoption of Ohio
Constitution, Article II, Section 1h, is ratified and entitled to
continue in effect, but may be subsequently amended or repealed. |
If adopted by a majority of the electors voting on this
proposal, Section 1h of Article II of the Constitution of the
State of Ohio takes effect January 1, 2015. |
