A BILL
To enact section 4141.49 of the Revised Code to
prohibit an employer from retaliating against the
employer's employees for testifying or otherwise
participating in an unemployment compensation
proceeding or hearing.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 4141.49 of the Revised Code be
enacted to read as follows:
Sec. 4141.49. (A) No employer shall discharge without just
cause, refuse to hire, or otherwise discriminate against any
employee of the employer with respect to hire, tenure, terms,
conditions, or privileges of employment, or any matter directly or
indirectly related to employment, because that employee testifies
or otherwise participates in a proceeding or hearing conducted
under this chapter.
(B) An employee who believes that the employee has suffered
an injury as a result of the employee's employer violation of
division (A) of this section may bring a civil action against the
employee's employer in the court of common pleas of the county
where the alleged violation occurred. If the court determines that
an employer has violated that division, the court may order any
relief that the court determines is appropriate.
