A BILL
To enact section 4113.14 of the Revised Code to
prohibit certain employers from requiring
employees to accept the employees' pay in the form
of a paycheck card.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1. That section 4113.14 of the Revised Code be
enacted to read as follows:
Sec. 4113.14. (A) As used in this section:
(1) "Employer" means an independently owned and operated
for-profit or nonprofit business entity, including affiliates,
that employs five hundred or more employees in this state.
(2) "Paycheck card" means a reloadable prepaid debit card
issued through a national or regional bank that takes the place of
a paper paycheck or the direct deposit of a paycheck.
(B) An employer, to the extent consistent with federal law
and subject to division (C) of this section, may pay an employee
of the employer the employee's wages using one or more of the
following methods:
(1) In lawful money of the United States;
(2) By check payable at face value upon demand in lawful
money of the United States;
(3) By electronic automated funds transfer in lawful money of
the United States into an account in the name of the employee at a
financial institution designated by the employee, provided that
the employee voluntarily gives written or electronic authorization
in advance to receive the employee's wages in this manner;
(4) By credit to a paycheck card.
(C) No employer shall require an employee of the employer to
accept the employee's wages for services performed for the
employer through a paycheck card. If an employer wishes to pay the
wages of an employee of the employer using a paycheck card, the
employer shall do both of the following:
(1) Offer to pay the employee using the methods described in
divisions (B)(1), (2), and (3) of this section in addition to
offering to pay the employee through a paycheck card;
(2) Permit the employee to select the method by which the
employer shall pay the employee's wages to the employee.
